Article 3 – Applicability

  1. These Terms and Conditions apply to every offer made by Muspaneel and every agreement concluded between us and the consumer through our online store.
  2. Before the agreement is concluded, these Terms and Conditions will be made available in such a way that the consumer can review and save them.
  3. In addition to these Terms and Conditions, additional terms or policies may apply, including our Returns and Refund Policy and Privacy Policy.
  4. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Article 4 – Our offers and products

  1. We make every effort to describe and display our products as fully and accurately as possible.
  2. Images are intended to provide the best possible representation of the product. Colours and the appearance of products may differ slightly from how they appear on a screen.
  3. Where relevant, product characteristics such as material, dimensions, finish and available options are stated.
  4. Obvious errors or mistakes in an offer, including clear pricing, typographical or input errors, are not binding on us.
  5. We reserve the right to change our product range, product information and prices. Such changes will not affect agreements that have already been concluded.

Article 5 – Conclusion of the agreement

  1. The agreement is concluded when the consumer completes the order through the online store and the order is confirmed by us.
  2. The consumer will receive an electronic confirmation after placing the order.
  3. The consumer is responsible for checking the order and the information provided before completing the order.
  4. We may refuse or cancel an order where there is a valid reason to do so, for example in the event of an obvious pricing or product error, suspected fraud or if a product unexpectedly becomes unavailable.
  5. If we cancel an order that has already been paid for, we will refund the relevant amount.

Article 6 – Custom-made products

  1. Part of our range can be made according to dimensions or other specifications provided by the consumer.
  2. This includes Muspanelen and other products produced specifically according to dimensions or specifications provided by the consumer.
  3. The consumer is responsible for correctly entering and checking the required dimensions, finish and other specifications before placing the order.
  4. The statutory right of withdrawal may be excluded for products made to the consumer's specifications that are not supplied as standard products from our range.
  5. If the right of withdrawal is excluded for a custom-made product, this will be clearly communicated to the consumer before the agreement is concluded.
  6. A product is not automatically considered custom-made solely because the consumer selects a standard available size, colour or finish.

Article 7 – Right of withdrawal

  1. When purchasing standard products through our online store, the consumer generally has the right to withdraw from the agreement without giving any reason within 14 days of receiving the product.
  2. If an order consists of several products or parts delivered separately, the withdrawal period begins after receipt of the final product or part.
  3. To exercise the right of withdrawal, the consumer must clearly inform us within the withdrawal period that they wish to withdraw from the agreement.
  4. After notifying us of the withdrawal, the consumer has a further 14 days to return the product.
  5. During the withdrawal period, the consumer may inspect and assess the product only to the extent necessary to establish its nature, characteristics and functioning.
  6. If the consumer handles the product beyond what is necessary to assess it and this results in a reduction in value, the consumer may be liable for that reduction in value.
  7. Further information about registering and returning a product can be found in our Returns and Refund Policy.

Article 8 – Exceptions to the right of withdrawal

The right of withdrawal may, among other things, be excluded for products that:

  1. are made to the consumer's specifications;
  2. are clearly personalised; or
  3. are excluded from the right of withdrawal for other statutory reasons.

For Muspaneel, the exception relating to custom-made products is particularly relevant.

Where the right of withdrawal does not apply to a product, this will be clearly stated before the agreement is concluded.

Article 9 – Costs and refunds in the event of withdrawal

  1. The direct costs of returning a product are borne by the consumer, unless we state otherwise or the product was delivered incorrectly, damaged or defective and we are responsible for this.
  2. If the entire order is withdrawn, we will refund the purchase price and the original standard delivery costs.
  3. If the consumer selected a more expensive delivery method than our standard delivery method, we are not required to refund the additional costs.
  4. If only part of an order is returned, the original delivery costs will not be refunded.
  5. We will refund the amount due no later than 14 days after notification of withdrawal.
  6. We may withhold the refund until we have received the product or until the consumer provides evidence that the product has been returned, whichever occurs first.
  7. The refund will be made using the same payment method used for the original order, unless otherwise agreed with the consumer.

Article 10 – Prices and payment

  1. All consumer prices stated in our online store are in euros and include VAT, unless expressly stated otherwise.
  2. Any shipping costs and other additional charges will be displayed before the order is completed.
  3. The price applicable at the time the order is placed will apply to the agreement.
  4. We may change our prices, discounts and promotions. Price changes will not affect orders that have already been confirmed.
  5. Obvious pricing, printing, typographical or input errors are not binding on us.
  6. Payment is made using one of the payment methods offered during checkout in our online store.

Article 11 – Conformity and statutory guarantee

  1. We warrant that the products supplied comply with the agreement and with what the consumer may reasonably expect from the product under the agreement.
  2. The consumer's statutory guarantee rights remain fully applicable.
  3. Any additional guarantee provided by us, a manufacturer or another party does not affect the consumer's statutory rights.
  4. If a consumer receives a damaged, incorrect or defective product, we ask them to contact us as soon as possible at info@panelsforartpainting.nl.
  5. We may request photographs or other information that enables us to assess the issue.
  6. Damage demonstrably caused by misuse, careless handling or failure to follow clear product or usage instructions is not considered a defect for which we are responsible.

Article 12 – Delivery

  1. We take the greatest possible care when processing and shipping orders.
  2. Delivery will be made to the address provided by the consumer when placing the order.
  3. Delivery times stated with products or during the ordering process are indicative unless expressly agreed otherwise.
  4. If an order cannot be delivered, or cannot be delivered within the agreed period, we will inform the consumer.
  5. If delivery proves impossible, the agreement may be terminated and we will refund any amounts already received for the relevant products.
  6. The risk of damage to or loss of products remains with us until the order has been delivered to the consumer or to a recipient designated by the consumer.
  7. Additional shipping conditions and charges may apply to products with unusual or large dimensions. Where applicable, these will be stated before the agreement is concluded.

  1. All text, photographs, images, designs, logos, product names and other content on our website are owned by Muspaneel / Atelier De Bunker or are used with the permission of the rights holder, unless otherwise stated.

Article 14 – Shopify and external service providers

  1. Our online store is technically powered by Shopify.
  2. The purchase agreement for products from our online store is concluded directly between the consumer and Muspaneel / Atelier De Bunker. Shopify is not the seller of our products.
  3. We may use external parties to provide our services, for example for payments, shipping, hosting or other online store functionality.
  4. The terms and privacy policies of those third parties may apply to certain services they provide.

Article 15 – Privacy

  1. We are responsible for the proper performance of the agreement in accordance with applicable law.
  2. We are not liable for damage resulting from incorrect or improper use of our products or failure to follow clear instructions for use.
  3. To the extent permitted by law, we are not liable for indirect or consequential loss or damage.
  4. Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is not permitted by mandatory law.
  5. The statutory rights of consumers remain unaffected.

Article 17 – Complaints

  1. If you have a complaint about an order, product or our service, please contact us at info@panelsforartpainting.nl.
  2. Please describe the complaint as clearly as possible, include the order number where relevant and attach photographs if appropriate.
  3. We aim to provide a substantive response to complaints as quickly as possible and no later than within 14 days. If more time is required, we will inform you within this period when a substantive response can be expected.
  4. If a complaint is justified, we will provide an appropriate solution in accordance with the consumer's applicable statutory rights.
  5. If we are unable to resolve the complaint together, the consumer may use any applicable out-of-court dispute resolution procedures.

Article 18 – Errors and inaccuracies

  1. Despite our best efforts, information in the online store may occasionally contain an error or inaccuracy.
  2. We may correct obvious errors and inaccuracies in, for example, product descriptions, prices, availability, offers and shipping information.
